It's great that you are covering U.S. international tax, because a lot of people don't know much about it, but there is a lot of misinformation in this video. The general idea is right, but most U.S. multinationals will be negatively impacted if the HW&M draft goes final, or even if anticipated Senate revisions are adopted. To illustrate how complex this analysis gets and why you can't just assume a company will be better off with this legislation instead of DST, one of the changes in the draft legislation is to limit FTCs in the GILTI basket on a country-by-country basis. Most U.S. MNCs are awash with credits, so the main impact GILTI has under current law is leakage through expense apportionment (which creates a gap between tax on GILTI income and allowable FTCs to offset). The HW&M draft does away with expense apportionment to GILTI, but imposes a Sec 904 limitation on a country-by-country basis. In the case of Ireland, this means U.S. companies will generally pay a top-up tax where they previously hadn't. This alone (to say nothing of the proposed Sec 163(n) earnings stripping rules or any other of the many revenue raisers in the draft legislation) could offset the benefit of doing away with DST in the countries that impose DST. I have not met any international tax professional who actually wants this legislation to pass, and I personally know a substantial proportion of all the international tax professionals in America that work in the large cap space.
