    You need to find out what the definition of plants is and if they specify only specific types. A patch of grass is not 1 plant. Its thousands of plants closely grown together and manicured. If the bylaws are not specific that's your loophole. Other than that quit buying in hoa. They say they keep your home value high. That's fine everyone wants to buy your 20 year old home in hoa for 200k the alternate is horrible a New home in hoa 200k everything is upgraded and to current standards.

    I don't understand why people seek to live in places with more rules instead seeking freedom. I have my eyes on Panama, less rules, no income tax on trading, ocean, forest and Panama City is beautiful with a booming real estate economy.

    Hey Ricky, seems like the depth of field is too shallow to allow for you and the screen to be in focus at the same time. Having only the foreground subject be in focus is really good for portraits, but for situations like these when you want to interact with something that sits further away from the camera, you should use a smaller aperture opening (in other words, a greater f value; like f8 or f11 instead of f2.8 ).     Problem is, HOA more like contract law. And its massive. I hate to say it, but odds are you are rather screwed. Arizona HOAs are rather well protected. HOA's are one of those things that you need to research how complex the rules are. And the HOA fees are considered profits for raising money So, the more they fine you, the more they get to keep. So, personally, you're kinda in a no win spot. And Arizona does nothing much to help protect you from bad HOAs. Best suggestion I can offer is to find a new place. But easier said, and you might like the place. So, you're gonna be stuck paying someone to manage it overall. Or the HOA will keep hitting you for anything the can to raise more money.
    You really have to research HOAs if you are gonna live with one.

    Did you read the condo association bylaws and rules before you bought the place ? They should have been in there and provided to you before you bought the property.

    Did you get a warning letter? Check your HOA agreement when you bought your home. You can always appeal the fine they can't arrest you but they can put a lean on your home. I would buy the plants and more get your home looking great and MOVE. The people who like the HOA are also on the board or know someone on the board of the HOA. When you move go into a neighborhood of mostly older people like I did. I get paid for doing odd jobs, I installed a ceiling fan yesterday and got $50. Bonus no homes painted Blue! Long story.

    There is no way I could live in one of those neighborhoods. Not about to let someone else tell me what I can or can’t do on my owe property that I payed for. Not enough plants in your front yard and an approved plant list give me a f###### break.
    HOAs are just bullies you pay to bully you
    My mother in law got a fine once because her grass was cut a 1/2 inch too long so make sure your landscaper has his mower deck on the right setting.

    I'm in Reno and used to live in a gated community with HOA when I owned that house. It was about $300 quarterly. Not sure what they did tbh… I did my own yard work but could have hired a company. If I had a yellow spot of grass or drops of oil on the driveway from working on friends cars, I would get a typed out letter in the mail to fix it or be fined for X amount of dollars. Having a car parked on the street for more than 48hrs without moving would get a warning ticket on the windshield and would get towed away. HOA's are no bueno

    You should have a set of CCR's…. read them and find out all the issues they are whining about. If you haven't read the CCR's and know the issues regarding parking regulations and landscaping. that's on YOU. I agree with the lawyer, the enforcement procedures are usually laid out in the CCR's. I've never seen an HOA that could fine without at least a series of warning letters and a hearing. The fine amounts are usually clearly documented as well. You are a thorn in their side and they are looking to make life miserable for you. Parking and the cars in that community have probably pissed off people that have nothing better to do than complain. I live in an HOA and they can royally suck sometimes with the micro-managing attitude. Spend more time researching the issues and less complaining about it on the web… 🙂

    My apartment building I'm renting in has an HOA. Its a well kept community and I haven't had any issues in my 3-4 months here, but I noticed my neighbor got a warning notice about leaving trash next to the dumpster (instead of inside it. I'm guessing it was full, but I dunno). While it has worked out for me here renting, I don't think I'd ever want to own a property with an HOA. The whole point of owning to me is doing more or less what you want with the property, and from what I've heard the minute you get a little creative or neglectful you're going to find you can't actually do what you want with your own property, at all. Plant the trees or flowers they require, sell the property, and buy a big house with more land in a more rural area with no HOA. And in the mean time stop drawing attention to your property and pissing off neighbors with your cars – they're not that much louder if you're not revving or skirting them. 😝

    Ricky, if you take this to court and the Judge can not easily find the list of plants required for your property on his/her own you have a good chance of winning the case. While the HOA/POA rules and fines are legitimate (as you signed the agreement) you can make an argument that they can not be enforced if the members can not easily find the information on what they are required to do.

    Sell that house now. Buy a piece of land and build the house that you want. Make sure the driveway is long and have a four car garage attached to the house. Then build a six car garage on each side of the driveway. Make sure they are directly across from each other. Be off just two feet and it looks weird . Never ever move into another house with a hoa . Those people just sit around looking for ways to take your money so you cannot afford the house payment .
