So all the goodwill that Nikcola may have garnered in the past has been lost from their recent actions. This will just AMPLIFY their news against them. Instead of spending their efforts to make an awesome product and making all this bad news go away, they took this route. This basically means that EVERY creator on YouTube will be negative to them! Creators are like ants! There are more of us than them.
Good luck with the lawsuit. These dirtbags have gone too far. But copyright abuse is rampant across many digital platforms. On Etsy the system works in reverse. If an artist, who has created a work and put it up for sale, files a DMCA claim against someone selling literally a copy-and-pasted work, it is an arduous process for said artist to prove that they actually own copyright on their work, despite copyright being AUTOMATICALLY applied to artistic works upon creation. So YouTube's way of 100% assuming Guilt is wrong, and Etsy's way of 100% assuming Innocence is also wrong. There needs to be a middle ground where claims are actually taken seriously and are actually investigated without channels being automatically banned. That probably means that there needs to be a "fair use request" during the upload and classifications for fair use defined and applied for by content creators. It also likely means (as mentioned by Transport Evolved) that corporations using YouTube for distribution of their B roll which is intended for journalists use need to be classified with the proper licenses or broad waivers allowing for general fair use. And in the case of Etsy it means the website needs to work with artists and allow them to register their original works with either the website or an online copyright registration.
Of course this problem also generally applies to all kinds of automated actions based on reporting abuse on social media platforms. The fact that I had my Facebook and Instagram accounts frozen several times simply for reporting too many spam accounts is crazy to me. A system that allows abuse and punishes the person reporting that abuse is also backwards. There has to be a better way.
