I have squatters in the new house I’m buying and there’s a threatened lawsuit. I have a rule that I won’t close a deal with people inside - I do not like inheriting people unless I’ve screened them as tenants - it’s too risky to close a deal with people still inside, the seller or other, unless they’re fully qualified. Especially in a state like California where it’s very difficult to evict someone, especially during a crisis where it’s impossible. The last thing I want to do is get stuck making payments for someone else. So I recommend closing a deal on HOLD - basically, giving me another opportunity to check the deal prior to closing. Unfortunately, the people get out. So rather than close the deal, I delay the deal and break down my step-by-step negotiations with the seller and attorney. After threatening a small claims lawsuit AND pulling strings and tricks with my lender and their attorney, I ended up striking a deal that made sense. Stay safe in real estate.
